1 Important aspects of our "24-Point Inspected & Certified" home inspection and home warranty program:

The purpose of our "24-Point Inspected & Certified" home inspection and warranty program (the "Program") is to facilitate the marketing and sale of homes listed for sale with ZipRealty, Inc. ("ZipRealty"). An initial home inspection covering twenty-four (24) specified items (the "Inspection") is intended to provide homeowners with reasonably reliable information about the physical condition of a particular home. The Inspection is not intended to replace any other inspections desired to be obtained by a home buyer, nor does it exempt the homeowner from disclosing to the broker and the buyer any known physical defects or conditions. The Inspection (i) is a limited, visual inspection of apparent conditions of the twenty-four specified items which are in readily and easily accessible areas that exist at the time of the Inspection, and (ii) is further limited to those specified items (the "covered items"). Based on local custom, an inspector may report on matters outside of these specified covered items and, hence, outside of our Program. Any and all visual problems observed in the Inspection should be discussed with an appropriate contractor, electrician, plumber, HVAC Technician, or other skilled professional. Certification means that a home has been inspected by a qualified, independent company, which has reported that the covered items are functioning substantially as intended. However, the inspector may note that one or more conditions exist which could affect usability or function if the condition, or conditions, are left unattended. If an inspector identifies a covered item as not functioning substantially as intended and requiring repair or replacement, a home will not pass Inspection, and will not be eligible to participate in the Program, until there is satisfactory proof that such item has been repaired or replaced, and has been re-inspected to verify that it is functioning substantially as intended. It is the homeowner's responsibility to repair or replace, as appropriate, and to pay for applicable re-inspection fees, if the homeowner desires to participate in the Program. The Program also involves a typical home warranty (the "Warranty") provided to a new home buyer. The warranty is separate from the Inspection and does not cover all of the Inspected items. The company providing both the Inspection and the Warranty is not owned or controlled by, and is a company separate from ZipRealty. ZipRealty is not a licensed home inspector or a provider of home warranties. The information contained in both the Inspection and the Warranty are not professional opinions, guarantees, or warranties of ZipRealty. A homeowner participating in the Program shall be deemed to understand, and will need to agree, that ZipRealty shall not be liable for any claim based on or related to the Inspection, Warranty, or any aspect thereof, including but not limited to liability for any defects or deficiencies in either the Inspection, or in, or about, the home; and that ZipRealty's liability, if any, shall be limited to any fees earned in connection with the sale of the Inspected home. The Program may not be available in all states. The Program is currently available only through LandAmerica.
