For Home Buyers Rebate is available only to buyers who close escrow/proceed to final settlement with ZipRealty acting as their sole and exclusive agent in the purchase of real estate. For homes with a final sales price of $100,000.00 or more, the rebate is twenty percent (20%) of the cooperating broker commission actually received by ZipRealty at the close of escrow/settlement for representing the buyer net of any allowances or other deductions by ZipRealty related to the transaction. The amount of the cooperating broker commission received will vary on individual properties. Occasionally, the seller and/or listing broker in a transaction will offer the broker representing the buyer a bonus or other additional incentive over and above the cooperating brokerage commission. Any such bonuses or other additional incentives are separate and apart from the cooperating brokerage commission actually received by ZipRealty and buyer is not entitled to a rebate on any bonus or other additional incentive monies paid to ZipRealty over and above the cooperative broker commission. For homes with a final sales price of $99,999.99 or less, ZipRealty will not pay a rebate. If a rebate is paid, the rebate will be paid or credited to the party or parties named as the "buyer(s)" or "borrower(s)" on the HUD-1 Closing Statement or equivalent official closing statement. In the case of an IRC §1031 Tax Deferred Exchange ("Exchange"), the party named as the "buyer or borrower" is the Qualified Intermediary (the "Exchange Company") and the rebate will be paid or credited to the Exchange Company for the benefit of the party conducting the exchange (the "Exchanger"). All buyers, or in the case of any Exchange, the Exchanger must sign this Rebate Agreement before any rebate will be issued. This rebate program is only available where permitted under state and federal law and when not otherwise prohibited by the buyer's lender(s). There may be tax consequences to the rebate. New Construction Rebate Terms In the event that ZipRealty refers and registers you as a buyer with a builder/developer, the builder/developer will often pay ZipRealty a cooperating broker commission at close of escrow/final settlement. The exact amount of compensation received by ZipRealty will vary based on the particular builder/developer. Be advised, many builders/developers require that an agent must personally accompany a prospective buyer to the development on the buyer's first visit for the agent to be entitled to receive any compensation. Unless prohibited by the builder/developer, ZipRealty would issue you a rebate as described above. For Home Sellers - Listing Terms and Disclosures ZipRealty charges either a competitive fee for the local area, typically 1% below the going rate for the area, or a Minimum Listing Fee, whichever is greater. Contact a ZipRealty agent for more information on ZipRealty's fees in your area. "Minimum Listing Fee" is $2,000.00 plus an agreed upon cooperating brokerage fee to be paid to a cooperating broker (broker who brings the successful buyer). The market rate for the cooperating brokerage fee may vary based on local custom and market conditions. All offers are subject to modification or discontinuation without notice. "Additional Profit", "Your Savings", and "Savings" are terms used to reflect an estimate of savings by listing with ZipRealty. Examples are based on a total 6% commission, charged by a "Traditional Agent", compared to 5% commission charged by ZipRealty. The total 6% commission is an estimate for purposes of comparing traditional real estate agents to ZipRealty's services. The actual final sales commission may vary based on individual brokerage practices, local custom and market conditions. ZipRealty's goal is to charge approximately 1% less than the going market rate in a local area. "Closing Cost Estimate" includes miscellaneous closing costs, other than brokerage commission(s), using 1% of the selling price of the property to estimate those costs. Actual amount may vary by area, local custom and each individual transaction. For Referrals To Other Brokers/Agents ZipRealty does not guarantee or warrant the services provided by real estate brokers/agents that ZipRealty refers to you. Each homebuyer/seller must independently verify the quality and experience of each real estate broker/agent that they hire. The commissions paid are subject to the agreement between the individual homebuyer/seller and the broker receiving the referral and may be negotiated between the parties. A homebuyer/seller who is represented by, or referred to, another broker is not eligible for a rebate or reduced commission from ZipRealty.
